Cependant, afin de pallier les risques de cybersquatting, les titulaires de droits ont la possibilit\u00e9 d\u2019intervenir entre le 16 mars et le 22 mai 2023.<\/span><\/p>\n<p>L\u2019heure a sonn\u00e9. Mis en place lors du lancement de l\u2019extension .XXX en 2011, le dispositif de protection destin\u00e9 aux titulaires de droits ant\u00e9rieurs n\u2019appartenant pas \u00e0 l\u2019industrie du charme prend fin d\u00e9finitivement et, d\u00e8s le 22 mai, les noms de domaine ayant b\u00e9n\u00e9fici\u00e9 de ce blocage seront alors accessibles \u00e0 tous. Pour rappel, il s\u2019agissait d\u2019un service payant propos\u00e9 par le registre et visant \u00e0 interdire l\u2019enregistrement des noms de domaine en .XXX identiques aux marques.<\/p>\n<p>Il reste donc <strong>deux mois et deux solutions pour agir<\/strong> :<\/p>\n<h3><strong>1. Enregistrer ces noms de fa\u00e7on d\u00e9fensive<\/strong><\/h3>\n<p>Enregistrer ces noms de fa\u00e7on d\u00e9fensive comme n\u2019importe quel nom de domaine classique en utilisant le \u00ab token \u00bb (jeton) li\u00e9 \u00e0 chacun des noms prot\u00e9g\u00e9s. Ce \u00ab token \u00bb authentifie l\u2019origine de la demande effectu\u00e9e par le titulaire l\u00e9gitime.<br \/>\nAttention, si ce jeton n&rsquo;est PAS utilis\u00e9 avant le 22 mai, le nom de domaine correspondant pourra \u00eatre enregistr\u00e9 par quiconque.<\/p>\n<h3>2. Utiliser les dispositifs AdultBlock et AdultBlock+<\/h3>\n<p>Il est aussi possible de convertir ce blocage en \u00ab Adultblock \u00bb, lequel permet d&#8217;emp\u00eacher tout enregistrement par un tiers dans les quatre extensions de l\u2019industrie du charme, \u00e0 savoir .XXX, .PORN, .SEX et ADULT. Adultblock permet notamment de prot\u00e9ger sa marque sans \u00eatre oblig\u00e9 de r\u00e9aliser un site pour adulte ou d\u2019avoir \u00e0 payer des frais de renouvellement annuels de nom de domaine. Ce service se d\u00e9cline en deux variantes :<\/p>\n<ul>\n<li><strong>Adultblock<\/strong> (service de base) permet aux demandeurs de bloquer l\u2019usage de leurs noms \u00e0 l\u2019identique, en une seule op\u00e9ration, dans les 4 extensions .XXX, .PORN, .SEX et ADULT ;<\/li>\n<li><strong>AdultBlock+<\/strong> ajoute \u00e0 ce service de base le blocage de toutes les variantes d\u2019une marque ou d\u2019un nom. Il couvre \u00e9galement les caract\u00e8res IDN et les homoglyphes (caract\u00e8res dont la ressemblance peut pr\u00eater \u00e0 confusion) et ce, dans plus de 20 langues (anglais, bi\u00e9lorusse, bosniaque, bulgare, chinois simplifi\u00e9 et traditionnel, danois, fran\u00e7ais, allemand, hongrois, islandais, italien, cor\u00e9en, letton, lituanien, mac\u00e9donien, mont\u00e9n\u00e9grin, polonais, portugais, russe, serbe, espagnol, su\u00e9dois, ukrainien).<\/li>\n<\/ul>\n<p>Ce dispositif pr\u00e9sente des avantages en termes de <strong>protection<\/strong> contre les conduites malveillantes, notamment celles susceptibles de nuire \u00e0 l\u2019image et\/ou \u00e0 la r\u00e9putation (cybersquattage, phishing, etc.).<\/p>\n<p>Toutefois, son co\u00fbt n\u2019\u00e9tant pas neutre, nous recommandons sa mise en place uniquement pour les <strong>noms de domaine susceptibles de pr\u00e9senter un risque majeur en termes d\u2019image, pouvant avoir une r\u00e9elle incidence sur le chiffre d\u2019affaires<\/strong>.<\/p>\n<h2>CONSEIL D\u2019EXPERT<\/h2>\n<p>Nous attirons l\u2019attention des titulaires de droits concern\u00e9s sur le fait que, sans intervention de leur part, <strong>les noms prot\u00e9g\u00e9s jusqu\u2019\u00e0 pr\u00e9sent retomberont d\u00e8s le 22 mai 2023 dans le domaine public<\/strong> et risquent alors d\u2019\u00eatre enregistr\u00e9s \u00e0 des fins de fraude, de cybersquatting ou toute autre forme de malveillance. Par cons\u00e9quent, nous conseillons \u00e0 ceux-ci de r\u00e9aliser au minimum un enregistrement d\u00e9fensif \u00e0 l\u2019identique de la marque.<\/p>\n<p>\u00c0 d\u00e9faut, <a href=\"https:\/\/ebrandservices.fr\/services\/x-ray-radar\/\"><strong>une surveillance X-RAY<\/strong><\/a> des enregistrements de noms de domaine leur permettra d\u2019\u00eatre inform\u00e9s d\u00e8s qu\u2019un tiers d\u00e9pose un nom identique ou similaire.
