Cependant, le service WHOIS qui permet d\u2019identifier le propri\u00e9taire d\u2019un nom de domaine, semble entrer en conflit direct avec ce nouveau r\u00e8glement europ\u00e9en. \u00c0 l\u2019heure o\u00f9 les abus sur Internet se multiplient, est-il encore possible d\u2019identifier le contrevenant ? Pour y voir plus clair, nous avons demand\u00e9 \u00e0 Luc Seufer, Directeur juridique du groupe EBRAND, de r\u00e9pondre \u00e0 nos questions.<\/strong><\/p>\n<p><strong>Pouvez-vous nous dire si et comment EBRAND est impact\u00e9e par l\u2019entr\u00e9e en vigueur du RGPD ?<\/strong><strong>\u00a0<\/strong><\/p>\n<p>EBRAND, de par sa client\u00e8le et les services qu\u2019elle propose, a une double casquette qui symbolise pleinement la probl\u00e9matique de l\u2019application du RGPD dans l\u2019industrie des noms de domaine. En tant que bureau d\u2019enregistrement nous sommes tr\u00e8s attach\u00e9s \u00e0 la protection des donn\u00e9es personnelles de nos clients. Aussi, hormis l\u2019anonymisation de nos bases de donn\u00e9es Whois, nous n\u2019avons pas eu \u00e0 effectuer de changement majeur dans notre mode de fonctionnement. Nous respections d\u00e9j\u00e0 la l\u00e9gislation en vigueur concernant la protection des donn\u00e9es \u00e0 caract\u00e8re personnel.<\/p>\n<p><strong>La presse anglophone et les titulaires de droits de propri\u00e9t\u00e9 intellectuelle ont publi\u00e9 de nombreux articles alarmant quant \u00e0 la \u00ab\u00a0mort du Whois\u00a0\u00bb et de ces cons\u00e9quences pour la s\u00e9curit\u00e9 des utilisateurs d\u2019internet. Pouvez-vous nous dire ce qu\u2019il en est\u00a0?<\/strong><\/p>\n<p>Je pense qu\u2019il faut en pr\u00e9ambule faire un bref historique afin de comprendre la situation actuelle. Depuis plusieurs ann\u00e9es, les sp\u00e9cialistes de la protection des donn\u00e9es personnelles ont averti l\u2019ICANN que ses r\u00e8glements enfreignaient le droit europ\u00e9en de protection des donn\u00e9es personnelles. L\u2019ancien Groupe de Travail de l\u2019article 29, devenu depuis le Comit\u00e9 Europ\u00e9en de la Protection des Donn\u00e9es, a d\u2019ailleurs adress\u00e9 de nombreuses lettres aux directeurs g\u00e9n\u00e9raux successifs de l\u2019ICANN. Malheureusement, aucun d\u2019eux n\u2019a pris r\u00e9ellement ces avertissements au s\u00e9rieux et les r\u00e9formes n\u00e9cessaires n\u2019ont jamais \u00e9t\u00e9 faites. C\u2019est donc dans l\u2019urgence que le Directeur G\u00e9n\u00e9ral actuel de l\u2019ICANN a d\u00fb faire voter un texte temporaire permettant aux bureaux d\u2019enregistrement et registres de prendre les mesures qu\u2019ils jugent ad\u00e9quates pour ne plus enfreindre le RGPD. Ce texte \u00e9tant assez vague tant quant \u00e0 sa mise en \u0153uvre que dans son champ d\u2019application, chaque registre et bureau d\u2019enregistrement a donc modifi\u00e9 sa gestion de ses bases de donn\u00e9es comme il l\u2019entend. Certains registres masquent toutes les coordonn\u00e9es des bases donn\u00e9es sans \u00e9gard quant au lieu de r\u00e9sidence du titulaire et de sa qualit\u00e9 de personne physique ou morale. D\u2019autres comme EBRAND publient une adresse email anonymis\u00e9e qui permet de contacter les titulaires \u00ab personnes physiques \u00bb et laisse accessible les coordonn\u00e9es des personnes morales. D\u2019autres encore publient un formulaire de contact sur leur site web. En quelque mois, il est devenu assez compliqu\u00e9 d\u2019avoir acc\u00e8s aux coordonn\u00e9es relatives aux titulaires de noms de domaine.<\/p>\n<p><strong>Mais n\u2019est-ce pas le r\u00f4le de l\u2019ICANN d\u2019imposer des standards \u00e0 l\u2019industrie\u00a0?<\/strong><\/p>\n<p>Lors de la r\u00e9union \u00e0 Panama City \u00e0 laquelle je participais, l\u2019ICANN a annonc\u00e9 que l\u2019\u00e9laboration d\u2019un nouveau r\u00e8glement allait \u00eatre initi\u00e9 rapidement afin qu\u2019une solution p\u00e9renne et universelle soit mise en place. Ce r\u00e8glement devrait \u00eatre \u00e9labor\u00e9 et promulgu\u00e9 avant la fin du mois d\u2019avril 2019. Cela peut para\u00eetre assez long mais si ce processus aboutit, cela sera un record de rapidit\u00e9 pour l\u2019ICANN. Pour m\u00e9moire, il a fallu plus de 10 ann\u00e9es pour que le programme de lancement des nouvelles extensions aboutisse.\u00a0L\u2019un des volets de ce r\u00e8glement devrait inclure la mise en place d\u2019un syst\u00e8me d\u2019acc\u00e8s diff\u00e9renci\u00e9 aux bases de donn\u00e9es Whois. Par exemple, les autorit\u00e9s gouvernementales et forces de l\u2019ordre auront acc\u00e8s une base de donn\u00e9es sp\u00e9cifiques. Les titulaires de droit de propri\u00e9t\u00e9 intellectuelle l\u00e9s\u00e9s auront quant \u00e0 eux acc\u00e8s \u00e0 une base de donn\u00e9es Whois d\u00e9di\u00e9e. M\u00eames dispositions pour les bureaux d\u2019enregistrement, les chercheurs en s\u00e9curit\u00e9 et les autres acteurs concern\u00e9s\u2026\u00a0Certains bureaux d\u2019enregistrement ont d\u00e9j\u00e0 mis en place, de leur propre initiative, des syst\u00e8mes d\u2019acc\u00e8s gradu\u00e9s \u00e0 leur base de donn\u00e9es Whois, mais sans qu\u2019aucun standard commun. Il faut donc obtenir l\u2019accord de chaque prestataire concern\u00e9, seul juge de la pertinence de la demande pour acc\u00e9der aux informations. Or, si les bureaux d\u2019enregistrement sont pour la plus part des prestataires techniques tr\u00e8s comp\u00e9tents, ils ne sont pas qualifi\u00e9s pour juger de la validit\u00e9 d\u2019une plainte d\u2019un tiers \u00e0 l\u2019encontre d\u2019un autre.<\/p>\n<p><strong>Cela veut-il dire que l\u2019internet est devenu une zone de non droit\u00a0?<\/strong><\/p>\n<p>Non car, au del\u00e0 de son droit local, chaque bureau d\u2019enregistrement est tenu par son contrat avec l\u2019ICANN. Celui-ci l\u2019oblige \u00e0 \u00e9tudier et r\u00e9pondre \u00e0 toutes les plaintes qu\u2019il re\u00e7oit concernant l\u2019utilisation faite des noms de domaines qu\u2019il a en gestion. Il est donc toujours possible d\u2019obtenir la suspension de noms de domaine au contenu litigieux \u2013 ce que font efficacement nos \u00e9quipes pour nos clients. En revanche, il reste difficile de savoir qui proc\u00e8de \u00e0 ces usages abusifs.<\/p>\n<p><strong>Dans ce cas, comment faites-vous pour identifier les contrevenants ? \u00a0<\/strong><\/p>\n<p>Ici encore le probl\u00e8me tient au fait qu\u2019il n\u2019y a pas de proc\u00e9dure standard et chaque gestionnaire de bases de donn\u00e9es Whois a une approche diff\u00e9rente. Certains demandent imp\u00e9rativement \u00e0 ce que leur soit fourni une d\u00e9cision de justice. D\u2019autres se contentent d\u2019une plainte r\u00e9pondant aux crit\u00e8res impos\u00e9s par la <em>Loi pour la confiance dans l\u2019\u00e9conomie num\u00e9rique <\/em>du 21 juin 2004pour les plaintes relatives au contenu. D\u2019autres ne savent que faire et restent malheureusement muet. Lorsque c\u2019est le nom de domaine qui est litigieux, alors les proc\u00e9dures URS et UDRP permettent en autre d\u2019initier une proc\u00e9dure d\u2019arbitrage et de lever l\u2019anonymat quant au titulaire du domaine en cause. Mais cette solution est pour le moins couteuse pour une simple lev\u00e9e d\u2019anonymat ! Cependant, les titulaires de droit ont \u00e0 leur disposition des solutions technologies innovantes d\u00e9velopp\u00e9es par les experts EBRAND.
